Welcome to the SaberCat File Hosting terms of service. Please read them fully.
All users must be of at least the age of 13, and agree to not use the SaberCat File Hosting service for any illegal or unauthorized purposes. All users must agree to comply with local laws regarding online conduct, and copyright laws. SaberCat File Hosting is intended for personal use, and any business use is strictly prohibited. All users must not use SaberCat File Hosting's services to violate any laws which include but are not limited to copyright laws. Any violations may result in immediate deletion of all files SaberCat File Hosting has on record for your IP Address.
All users use SaberCat File Hosting at their own risk, users understand that files uploaded on SaberCat File Hosting are not private (unless user has set their files to private), they may be viewed for administrative purposes (such as to check in response to copyright violation reports) although files will not be made public unless user decides to share the file publicly; and SaberCat File Hosting users understand and agree that SaberCat File Hosting cannot be responsible for the content posted on its web site and you nonetheless may be exposed to such materials and that you use SaberCat File Hosting's service at your own risk.
- We reserve the right to modify or terminate the SaberCat File Hosting service for any reason, without notice at any time. However, we will do our best to notify you if any such rare case may occur, and such an event would be highly unusual.
- We reserve the right to refuse service to anyone for any reason at any time.
We take privacy extremely seriously. All the files you upload are encrypted and can't be accessed. If downloaded manually for example in the case of a server breach, the files are both encrypted and also show just a random string of letters and numbers so an unauthorized party couldn't even know what file they accessed.
That said, we don't allow malicious content. We draw the line at child pron. We don't allow uploading of viruses and malware. If discovered, it will be purged. We don't allow any pron to be uploaded to the site. (This word is misspelled on purpose so it doesn't show in search.)
Data use on login to third-party sites is totally private. We don't see it, keep it, look at it, or use it in any way or for anything. If you log in with Twitter, Facebook, or Google, or some other site, or give your email, we don't ever see that and it is only used for login purposes.
Employees do not have access to user logins or any data. For example, Twitter signin may request your picture and access to some data. Actually all it really wants is just to fetch your user picture and username and such to setup your new account if you sign up using it. Employees don't have access to this and therefore can't use it for anything since they can't even see it.
Your email used at signin if choosing that login method, is not used for any purpose. It isn't stored anywhere, it only is used for your signing. It isn't accessible to anyone. It isn't used for any purpose, we don't send out mass emails, we don't collect your email, we don't sell your email or data. All we care about is making a great site for you to upload your stuff to SaberCatHost safely and easily.
Actually it doesn't even use a cookie for uploading. If you reload the page actually it loses your upload. This is for privacy reasons. No one can find any way to intercept your files during upload. It only happens right in the browser window and no permanent cookies are ever stored.
User shall indemnify and hold harmless SaberCatHost (and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees) from any and all claims, damages, liabilities, costs, and expenses (including, but not limited to, reasonable attorneys' fees and all related costs and expenses) incurred by SaberCatHost as a result of any claim, judgment, or adjudication against SaberCatHost related to or arising from (a) any photographs, illustrations, graphics, audio clips, video clips, text, data or any other information, content, display, or material (whether written, graphic, sound, or otherwise) provided by User to SaberCatHost (the "User Content"), or (b) a claim that any user's, visitor', or SaberCatHost's use of the User Content infringes the intellectual property rights of any third party.
SaberCatHost is not liable or responsible for any data uploaded by users. Let it be known that by use of this site, you hereby indemnify and hold harmless SaberCatHost and its directors, officers, employees, agents, stockholders, affiliates, subcontractors and customers from and against all allegations, claims, actions, suits, demands, damages, liabilities, obligations, losses, settlements, judgments, costs and expenses (including without limitation attorneys' fees and costs) which arise out of, relate to or result from any act or omission of
users. We will do our best to address any legal concerns within reason in good faith but legally we are not responsible for anything any user uploads. We are merely providing a service to make the world a better place. Be responsible, and be aware that SaberCatHost is completely and utterly indemnified against all uploaded content.
SaberCat File Hosting claims no intellectual property rights over the images or any of the data uploaded by its users.
SaberCat File Hosting will review all © copyright & infringement claims received and remove files found to have been upload or distributed in violation of any such laws. To make a valid claim you must provide SaberCat File Hosting with the following information:
- A physical or electronic signature of the copyright owner or the person authorized to act on its behalf;
- A description of the copyrighted work claimed to have been infringed;
- A description of the infringing material and information reasonably sufficient to permit SaberCat File Hosting to locate the material;
- Your contact information, including your address, telephone number, and email;
- A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
- A statement that the information in the notification is accurate, and, under the pains and penalties of perjury, that you are authorized to act on behalf of the copyright owner.
DMCA requests must be made by the actual owner of the copyright and not any third-party. If any of the information for any DMCA request is invalid or not by original copyright holder, it will be considered invalid. If the content is not found to be infringing or DMCA information is invalid, no action will be taken.
